    RESPONSE TO COLLEEN - 8/11/2022 Further to Colleens response of 8 November 2022 incorrectly noting the outcome of The NSW Civil & Administrative Tribunals decision, it is important to note that discussions relating to legal proceedings online is unprofessional. All matters should be dealt with through appropriate channels. However, to clarify Colleens (Glorious Flooring) statement, NCATs orders were dismissed without prejudice (dismissed temporarily). The tribunal member stated that I have the right to appeal as I do not have a legal background (I am not a solicitor) and did not have my witnesses present and did not know to have a statement by them lodged as part of the evidence to be provided. On the other hand, Colleens legal representative was denied the right to represent her. In relation to the defamation she speaks of, the tribunal member also advised her solicitor that he did not have a case. An honest google review by me which can be substantiated does not qualify as defamatory. Colleen was not awarded any costs and did not win any case and I reserve the right to take the matter further in due course. There was a material breach of contract by Colleen and no remedy was offered. In the spirit of putting the matter to rest and moving forward, I decided to let the matter go. However, if necessary, the additional evidence required to establish that Colleen is still not entitled to the $800 she withholds, will be presented in court or in any other avenue which will be pursued by either party. As a professional myself, a word of advice to Colleen, professional communication in terms of disagreements between yourself and a customer plays an important role in the way your company will be perceived and the reputation it gains in the future. Adopting and implementing correct conflict resolution strategies will minimise the impact of the outcome. It is unfortunate that a peaceful resolution was not reached and I wish Colleen of Glorious Flooring all the best in her future endeavours. Rowan. Unfortunately my experience with Glorious Flooring is very poor. I will consider changing my review depending on the outcome as Colleen has decided to keep an $800 deposit. (She is now trying to back charge me $250 for a free quote!!!! Have you heard of that before??? Incredible When i asked for a quote for flooring i was shown a single plank sample of consistent colour. On the day of install it became clear there was a large variation of colours between planks. This may be how the product is but it is not something i was shown or agreed to. On the morning of the install Colleen threatened me that i must text her a confirmation that i agree to the colour variation or she cant do the job. I did not agree to this colour variation and so agreed to not have the product installed. Colleen has now sent me an email which details the following which she claims are her losses: (Fyi the installer was at our property for 30mins total and none of the product was cut) measurement quote: $250 -Loss of labours for 2 workers for 2 days (06/01/22 & 07/01/22, we have booked in 2 days for the job as the size is 140m2): $400 for each person and each day, so the total for the labours losses are: $400 x 2 persons x 2 days = $1600 -Loss of 5 boxes of timber flooring as they have been opened and cut: 5 boxes x 1.3899m2 x $39 = $271 Total loss: $2,121 + GST = $2,333.10 As i said previously i will change this review if my deposit is returned. However if it is not returned i will continue with Fair Trading mediation between us and detail my further experience in this google review.
